By accessing or using FileSwift ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and FileSwift. We reserve the right to modify these Terms at any time. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.

FileSwift is an online file conversion platform that allows you to convert files between supported formats. The Service is available via fileswift.io and operates on a freemium model with a free plan and a paid Pro subscription.

We reserve the right to add, modify, or remove features from the Service at any time without prior notice.

You agree to use the Service only for lawful purposes. You must not upload, convert, or otherwise process files that:

• Contain malware, viruses, or other malicious code
• Infringe any third-party intellectual property rights
• Contain or depict illegal content, including but not limited to child sexual abuse material (CSAM)
• Are intended to facilitate illegal activities
• Violate any applicable law or regulation

We reserve the right to suspend or terminate your account immediately if we have reason to believe you are violating these restrictions.

FileSwift offers a free plan with the following limitations:

• 5 conversion jobs per day
• Limited batch size
• File size limits per upload

Free plan limits may be adjusted at any time. We will endeavour to communicate significant changes in advance.

Trial Period: New Pro subscribers receive a 7-day free trial. You will not be charged during the trial period. You may cancel at any time before the trial ends to avoid being billed.

Billing: After the trial, your subscription renews automatically on a monthly basis. Payment is processed securely via Stripe using the payment method you provide at checkout.

Pro Features: Pro subscribers receive unlimited conversion jobs per day, larger batch sizes, higher per-file size limits, and priority access to new features as they become available.

Cancellation: You may cancel your Pro subscription at any time from your Account Settings page. Cancellation takes effect at the end of the current billing period. You will retain Pro access until the period ends.

We offer a 7-day free trial to allow you to evaluate the Pro plan before being charged. Given that a free trial is provided, we do not offer refunds after the trial period has ended and a charge has been made, except where required by applicable law.

If you believe you have been charged in error, please contact us at hello@fileswift.io within 7 days of the charge and we will review your case.

We aim to keep FileSwift available and operational at all times, however we do not provide a service level agreement (SLA) or uptime guarantee at this stage. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

We are not liable for any losses or damages resulting from Service downtime or unavailability.

Your Files: You retain full ownership of all files you upload to FileSwift. By uploading files, you grant us a limited, temporary licence to process and convert them solely for the purpose of providing the Service to you. We claim no ownership over your files.

Our Platform: FileSwift, including its name, logo, design, code, and content, is the intellectual property of FileSwift. You must not reproduce, distribute, or create derivative works from the platform without our written permission.

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms. By using FileSwift, you consent to our data practices as described therein.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that the converted output will meet your specific requirements.

We are not responsible for any inaccuracies or data loss that may result from the conversion process. We strongly recommend keeping backups of your original files.

To the maximum extent permitted by applicable law, FileSwift and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim, or £50, whichever is greater.

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, engage in fraudulent activity, or threaten the security or integrity of the Service.

You may close your account at any time from your Account Settings page. Upon termination, your personal data will be deleted in accordance with our Privacy Policy.
